that the cost of the car hire is often not fully recovered from the driver at fault and you will have to pay the difference. The text doesn't tell you that the solicitor they appoint for you may not be entirely independent in their representation and advice.

A personal injury can be life changing and a compensation award can make all the difference. Compensation awards cover many aspects of loss from loss of earning to pain and suffering, medical expenses and a decline in quality of life. Adjusters will determine fault - Each insurance company's adjuster will weigh the statements of each driver and any witnesses — plus the information in the police report and any other evidence — and make a determination of who is at fault for the accident. In the rare cases when they cannot agree, fault will be determined by a lawsuit in civil court.

Russell v. Turcott, 2009 ABQB 19. The 27 year old female Plaintiff was seat belted and stopped at a stop sign in a 60km zone. The Defendant's vehicle struck the Plaintiff from behind and did not show visible signs of slowing down. The Plaintiff suffered the following injuries: moderate to severe whiplash injury (pain from her neck to her waist), injury to jaw with immediate headaches, chronic pain, fibromyalgia, and TMJ. Other issues followed: post-traumatic stress disorder, depression, tender points and general anxiety disorder. The Defendants admitted liability but argued that there was a lack of mitigation on the part of the Plaintiff.

We are asked regularly about how much the personal injury claim is worth. However it is difficult to assess the value of any claim without considering a large number of facts. Some of these facts include the nature of your injury, the cause of the injury and the impact that the injury has on your ability to work and/or on your activities of daily living including homecare and recreational activities.
